Welcome to TownCentre, your local online marketplace. These Terms and Conditions ("Terms") govern your purchase of goods and services ("Items") through our platform at towncentre.au ("Platform"). By checking the box to agree to these Terms during checkout, you ("Buyer" or "you") agree to be bound by these Terms. If you do not agree, you may not complete your purchase.
1. About TownCentre
TownCentre operates as a marketplace connecting Buyers with local merchants ("Merchants") in Australia. We do not sell Items directly; instead, we facilitate transactions between you and the Merchants. The contract of sale for any Item is between you and the Merchant, with TownCentre acting as an intermediary.
2. Placing an Order
When you place an order through the Platform:
- You agree to purchase the Item(s) from the Merchant as listed.
- You confirm that all information provided (e.g., delivery address, payment details) is accurate and complete.
- TownCentre will send you an order confirmation via email, but this does not guarantee the Merchant can fulfill the order (e.g., if an Item is out of stock).
3. Payment
Payments are processed securely through our payment gateway:
- You agree to pay the total amount shown at checkout, including any applicable taxes or delivery fees.
- Payment must be made at the time of purchase using a supported payment method (e.g., credit/debit card).
- TownCentre holds the payment on behalf of the Merchant and releases it once the order is confirmed as fulfilled, subject to our refund policies.
4. Delivery
Delivery of Items is handled by the Merchant, not TownCentre:
- Estimated delivery times are provided by the Merchant post checkout but are not guaranteed.
- You will receive tracking information if available.
- If an Item does not arrive within the estimated timeframe, you may contact the Merchant directly or reach out to TownCentre support for assistance.
- Risk of loss or damage to the Item passes to you upon delivery.
5. Returns, Refunds, and Cancellations
We want you to be satisfied with your purchase. Returns, refunds, and cancellations are subject to the following:
- Cancellations: You may cancel your order before the Merchant ships the Item. Once shipped, cancellations are subject to the Merchant’s return policy.
- Returns: You may return an Item within 14 days of delivery if it is unused, in its original condition, and in accordance with the Merchant’s return policy. You are responsible for return shipping costs unless the Item is faulty.
- Refunds: Refunds will be processed to your original payment method within 7 business days of the Merchant receiving the returned Item. Refunds for faulty Items will include return shipping costs.
- Faulty Items: If an Item is faulty, damaged, or not as described, you are entitled to a remedy under the Australian Consumer Law (ACL), such as a refund, repair, or replacement. Contact the Merchant or TownCentre support to arrange this.
6. Your Rights Under Australian Consumer Law
Nothing in these Terms excludes or limits your statutory rights under the Australian Consumer Law (ACL). As a consumer, you are entitled to:
- Goods of acceptable quality, fit for purpose, and matching their description.
- Services provided with due care and skill.
- Remedies (e.g., refunds, repairs) for goods or services that fail to meet these guarantees.

7. TownCentre’s Role and Liability
As a marketplace, TownCentre facilitates transactions but is not the seller of the Items:
- We are not responsible for the quality, safety, or legality of Items sold by Merchants.
- We do not guarantee the accuracy of listings or the ability of Merchants to fulfill orders.
- Our liability is limited to the amount you paid for the Item, and we are not liable for any indirect or consequential losses (e.g., loss of profits).
- We will assist in resolving disputes between you and the Merchant but are not obligated to provide remedies beyond what is required by law.
8. Privacy
Your personal information (e.g., name, address, payment details) will be handled in accordance with our Privacy Policy. By purchasing through the Platform, you consent to sharing necessary information with the Merchant to fulfill your order.
9. Dispute Resolution
If you have an issue with your purchase:
- First, attempt to resolve the issue directly with the Merchant.
- If unresolved, contact TownCentre support at support@towncentre.au. We will mediate the dispute in good faith.
- If the dispute remains unresolved, you may escalate it to external bodies such as the Australian Competition and Consumer Commission (ACCC).
10. Changes to These Terms
We may update these Terms from time to time. The updated Terms will apply to purchases made after the changes are posted. We will notify you of significant changes via email or a notice on the Platform.
11. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
